These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”, “Client”) and Safe Express Packers and Movers (“Company”, “we”, “our”, “us”) governing the use of our website www.safeexpresspm.com and our relocation, packing, moving, transportation, storage, and logistics services across India.
By accessing our website, requesting a quotation, booking a service, or engaging with us in any manner, you confirm that you have read, understood, and agreed to be legally bound by these Terms.
1. Service Scope
The Company provides household shifting, office relocation, commercial goods transport, vehicle transportation, packing, loading, unloading, unpacking, storage, and logistics coordination services. Service details shall be finalized based on written quotation and confirmation.
2. Quotations & Pricing Policy
All quotations are provided based on the information supplied by the customer. If actual goods volume, manpower requirement, distance, floor access, packaging material, or additional services differ from initial details, revised pricing may apply.
The Company reserves the right to adjust pricing in case of unforeseen operational requirements or statutory charges imposed by authorities.
3. Booking Confirmation
A booking shall be considered confirmed only after advance payment and written confirmation via email, SMS, or invoice. The Company may refuse service if booking requirements are not fulfilled.
4. Payment Terms
Advance payment may be required at the time of booking. Remaining balance must be cleared before delivery unless otherwise agreed in writing. Non-payment may result in withholding delivery.
5. Customer Obligations
- Provide accurate inventory details.
- Declare fragile, antique, or high-value goods.
- Ensure clear access for loading/unloading.
- Arrange permissions for restricted societies or buildings.
- Ensure compliance with transport regulations for certain goods.
6. Prohibited Items
Customers must not include explosives, flammable materials, perishable goods, illegal substances, firearms, narcotics, chemicals, or items prohibited under Indian law.
7. Insurance & Risk Coverage
Transit insurance is optional but strongly recommended. In the absence of insurance coverage, liability for loss or damage shall be limited and calculated as per declared value and standard transport norms.
The Company shall not be liable for minor scratches, wear and tear, mechanical failures of electronic items, or damages caused due to pre-existing defects.
8. Delay & Transit Time
Estimated delivery timelines are indicative only. Delays may occur due to weather conditions, traffic congestion, government checks, strikes, road closures, accidents, or other events beyond the Company’s reasonable control.
9. Claims Procedure
All claims must be reported in writing within 24 hours of delivery. Claims submitted after this period may be rejected. Customers must provide photographic evidence and relevant documentation.
10. Refund Policy
Refunds are subject to cancellation timing and operational expenses incurred. Advance payments may be partially refundable depending on preparation costs, labor arrangements, vehicle allocation, and packing material expenses.
11. Limitation of Liability
Under no circumstances shall Safe Express Packers and Movers be liable for indirect, incidental, special, punitive, or consequential damages including business interruption or loss of profit.
12. Force Majeure
The Company shall not be held liable for failure or delay in performance caused by events beyond reasonable control including natural disasters, floods, earthquakes, pandemics, government restrictions, riots, strikes, or acts of God.
13. Arbitration & Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved amicably. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in India, and proceedings shall be conducted in English.
14. Governing Law
These Terms shall be governed by the laws of India. Courts of competent jurisdiction in India shall have exclusive jurisdiction.
15. Website Usage Terms
Users agree not to misuse the website, upload malicious content, attempt hacking, or engage in fraudulent activities. All website content remains the intellectual property of the Company.
16. Privacy Compliance
Customer data is handled in accordance with applicable Indian laws including the IT Act, 2000 and Digital Personal Data Protection Act, 2023.
17. Modification of Terms
The Company reserves the right to modify these Terms at any time without prior notice. Continued use of services constitutes acceptance of revised Terms.
